Venmo, Zelle and PayPal Taxes in New Jersey: What Gets Reported in 2026

Executive Summary for the Taxpayer
If you use Venmo, PayPal, Zelle, or another payment app for business, the absence of a Form 1099-K does not make the income tax-free. For 2026 federal reporting, most third-party settlement organizations generally use the restored threshold of more than $20,000 in gross goods-and-services payments and more than 200 transactions, but taxable income must still be reported below that threshold. IRC § 6050W(e); IRS FS-2025-08

The 2026 federal 1099-K threshold
The One Big Beautiful Bill Act restored the federal Form 1099-K threshold for third-party settlement organization payments. A platform generally must issue Form 1099-K when both requirements are met:
- More than $20,000 in gross payments for goods or services
- More than 200 transactions during the calendar year
This change was enacted by Pub. L. 119-21, § 70432(a)(1), effective as if included in the American Rescue Plan Act’s § 9674, retroactively repealing the $600 ARPA threshold for this category. IRC § 6050W(e); [Pub. L. 119-21, § 70432(a)(1)]; IRS FS-2025-08
Both prongs matter. An 18-year-old with $40,000 of goods-and-services payments across 150 transactions does not meet the federal 1099-K threshold, and neither does someone with 400 transactions totaling $9,000. [IRC § 6050W(e)]; [IRS FS-2025-08]
Payment card transactions are different. Credit-card, debit-card, and similar payment-card transactions are reportable without a de minimis dollar or transaction-count threshold. IRC § 6050W(a), (c)(2); [IRS FS-2025-08]
What payment activity counts
The federal 1099-K rules cover payment flows for goods and services processed through a third-party settlement organization, such as certain Venmo, PayPal, marketplace, or payment-platform transactions. The form reports payment flow, not your final profit. [IRC § 6050W(a), (e)]; [IRS FS-2025-08]
Generally nonreportable personal transfers include:
- Reimbursement for a shared meal
- Splitting rent or household bills with roommates
- Gifts
- Family support
- Personal reimbursements that are not payment for goods or services
[IRS FS-2025-08, common situations Q1 and Q3]
A personal payment can still be mischaracterized by a platform and appear on a Form 1099-K. The IRS explains that the platform generally will not correct the form for you; an erroneous amount may need to be reported as an adjustment in the entry space at the top of Schedule 1, Form 1040, rather than treated as Schedule C business income. [IRS FS-2025-08]
The key point is simple: the reporting threshold is not a tax exemption. Gross income is generally includible unless the Internal Revenue Code excludes it, and payment app tax reporting does not determine whether business income is taxable. IRC §§ 61, 6041; [IRS FS-2025-08]

1099-K versus 1099-NEC
Form 1099-K reports gross payment-card and third-party-network payment flow under IRC § 6050W. Form 1099-NEC reports nonemployee compensation under IRC § 6041A. IRC §§ 6050W, 6041A
For payments made after December 31, 2025, the federal 1099-NEC reporting threshold is generally $2,000 under the OBBBA. [IRC § 6041A]; [Pub. L. 119-21, § 70431]
These forms are not interchangeable:
- A customer paying a freelancer through Zelle may create a 1099-NEC issue for the payer, even though Zelle does not issue Form 1099-K.
- A payment platform may issue Form 1099-K for gross transactions without showing expenses or profit.
- The same transaction should not be double-reported merely because more than one payment method or information return is involved. [IRS FS-2025-08, third-party filers Q11]
How Form 1099-K works
Box 1a reports gross payment-card and third-party-network transactions. It does not automatically subtract:
- Platform fees
- Refunds
- Shipping costs
- Chargebacks
- Inventory or other cost basis
The standard federal timing is:
- Payee statement due: January 31
- Federal paper filing due: February 28
- Federal electronic filing due: March 31
IRS Instructions for Forms 1099-MISC and 1099-NEC
Box 4 reports backup withholding. Federal backup withholding is governed by IRC § 3406, and eligible withholding shown in Box 4 is claimed on the taxpayer’s return. IRC § 3406
New Jersey’s $1,000 information-return rule
New Jersey requires state copies of covered information returns, including Forms 1099, when the amount paid or credited is at least $1,000, or when New Jersey tax was withheld. The standard deadline is February 15 following the close of the calendar year. N.J.A.C. 18:35-8.1(b)-(c)
New Jersey sets its own information-return filing threshold at $1,000, with no transaction-count minimum, so reporting to the Division begins well below the federal $20,000-and-200-transaction test. Separately, the IRS recognizes that a state may apply a lower 1099-K threshold than the federal one, which can mean a form reaches you even when the federal test is not met. Neither rule changes whether the income is taxable. N.J.A.C. 18:35-8.1(b)-(c); IRS FS-2025-08
If you are not sure whether your payment-app activity is taxable in New Jersey, Brick Taxes at 732-540-1040 can reconcile your platform statements against your bank deposits before you file.
New Jersey taxes separate categories of income under the New Jersey Gross Income Tax Act. Net profits from a business are generally computed using the same method and period as the federal return, subject to New Jersey adjustments. [N.J.S.A. 54A:5-1]; [N.J.A.C. 18:35-1.1]
Business income is reported on line 18 of Form NJ-1040 with applicable Schedule NJ-BUS-1 adjustments. A business loss generally cannot offset wage income under New Jersey’s gross income tax structure. [N.J.S.A. 54A:5-1]; New Jersey Form NJ-1040 instructions
If a Form 1099-K is wrong, the federal income is first corrected on Schedule 1, and the New Jersey return generally starts from the corrected federal figure, subject to New Jersey rules and adjustments. [N.J.A.C. 18:35-1.1]
Quarterly estimated payments for 2026
Federal estimated payments may be required when withholding and credits will not cover the taxpayer’s expected liability. The 2026 federal due dates are:
- April 15, 2026
- June 15, 2026
- September 15, 2026
- January 15, 2027
The federal safe harbor is generally the smaller of:
- 90 percent of current-year tax
- 100 percent of prior-year tax
- 110 percent of prior-year tax when prior-year adjusted gross income exceeded $150,000, or $75,000 for married filing separately
[IRC § 6654(d)]
New Jersey generally requires estimated payments when more than $400 of tax is expected after withholding and credits. The state standard is generally 80 percent of current-year tax or 100 percent of prior-year tax, computed with Form NJ-2210 and declared through Form NJ-1040-ES. [N.J.S.A. 54A:8-4]; New Jersey Form NJ-2210 and NJ-1040-ES instructions

Worked New Jersey payment-app example
Assume a New Jersey reseller and freelancer receives:
- Venmo: $6,000 from 18 customer service payments
- PayPal: $21,500 from 210 goods-and-services payments
- Zelle: $8,000 from customer payments
- Roommate reimbursement: $1,200, personal and not business income
The reportable business receipts total $35,500. The PayPal activity exceeds both federal 1099-K tests, so PayPal would generally issue a 1099-K showing $21,500 gross, not profit. Venmo would not meet the federal threshold based on the stated transaction count, and Zelle does not issue Form 1099-K, but both business amounts remain taxable income. [IRC § 6050W(e)]; [IRS FS-2025-08]
If documented business expenses total $9,500, the arithmetic net business profit is:
- $35,500 gross receipts
- Minus $9,500 expenses
- Equals $26,000 net profit
For illustration only, assume the taxpayer’s projected federal tax after credits and withholding is $8,000, while the prior-year tax was $7,000. The federal safe-harbor comparison is $7,200, or 90 percent of current-year tax, versus $7,000, or 100 percent of prior-year tax, making the annual target $7,000, or $1,750 per federal installment. [IRC § 6654(d)]
Assume projected New Jersey tax after withholding and credits is $3,200, with prior-year tax of $3,000. The state comparison is $2,560, or 80 percent of current-year tax, versus $3,000, or 100 percent of prior-year tax, making the annual target $3,000, or $750 per New Jersey installment. Frequently asked questions
Do I owe tax if I did not receive a 1099-K?
Yes, taxable business income generally must be reported whether or not a platform issues an information return. [IRC § 61]; [IRS FS-2025-08]
Does Zelle issue Form 1099-K?
Zelle generally does not issue Form 1099-K, but business payments received through Zelle remain reportable income. A payer may have separate Form 1099-NEC obligations. [IRC §§ 6041A, 6050W]; [IRS FS-2025-08]
Are roommate reimbursements taxable?
A genuine personal reimbursement, shared bill payment, gift, or family-support transfer is generally not payment for goods or services. Keep records showing the personal purpose in case the transaction is later mischaracterized. [IRS FS-2025-08, common situations Q1 and Q3]
What if my 1099-K includes personal payments?
Do not place personal reimbursements on Schedule C as business receipts. Follow IRS instructions for reporting the erroneous amount as an adjustment on Schedule 1, Form 1040, and retain records supporting the correction. [IRS FS-2025-08]
Can Brick Taxes help if I receive an IRS notice?
